Bimba Terms of Service
Terms governing the Bimba website, mobile application, account, and mobility platform.
Effective date: August 7, 2026
These Terms of Service (“Terms”) are a binding agreement between you and 3-102-968605 S.R.L., the Costa Rican company that operates the Bimba rental service (“Bimba,” “we,” “us,” or “our”). Bimba Eco Bike S.R.L. owns certain vehicles and related business assets but does not directly operate rental activities. These Terms govern the website, application, account, communications, and technology platform. Every rental and use of a vehicle is also governed by the Rider Agreement and Liability Waiver and Release presented before riding. If you do not agree, do not create an account, unlock a vehicle, or use the Services.
Important notice
THE RIDER AGREEMENT CONTAINS ASSUMPTION-OF-RISK, RELEASE, INDEMNIFICATION, LIMITATION-OF-LIABILITY, INDIVIDUAL ARBITRATION, AND CLASS-ACTION-WAIVER PROVISIONS. REVIEW IT CAREFULLY BEFORE RIDING. NOTHING IN THESE TERMS EXCLUDES A RIGHT OR REMEDY THAT CANNOT LAWFULLY BE WAIVED UNDER COSTA RICAN LAW.
1. Eligibility and authority
You must be at least 18 years old, legally capable of entering a binding agreement, and physically and mentally able to use the Services safely. You may use the Services only for yourself and may not create an account for a minor or permit another person to ride through your account. If you act for an organization, you confirm that you have authority to bind it.
2. Account registration and security
Provide accurate, current, and complete information and keep it updated. You are responsible for your credentials and all activity under your account. Do not share verification codes, passwords, or account access. Notify Bimba immediately of suspected unauthorized use. We may require identity, age, payment, or account verification and may reject, suspend, or close an account when information is inaccurate, eligibility cannot be confirmed, payment fails, safety is at risk, or these Terms are violated.
3. The Services and vehicle availability
The Services may allow you to find, reserve, unlock, rent, operate, and park Bimba vehicles, view pricing and ride history, and contact support. Availability, battery level, location, service area, vehicle type, and estimated range are not guaranteed. A map marker or reservation does not guarantee that a vehicle will remain available, operational, or suitable when you arrive.
Bimba may change, limit, suspend, or discontinue features, operating areas, vehicle types, or hours for safety, maintenance, legal, operational, weather, emergency, or business reasons, subject to applicable consumer law.
4. Rider Agreement controls vehicle use
Before unlocking or using a vehicle, you must review and accept the current Rider Agreement. It governs riding rules, permitted areas, inspection, parking, risk allocation, damage, loss, liability, indemnification, and dispute resolution connected with vehicle use. If these Terms conflict with the Rider Agreement regarding a rental or ride, the Rider Agreement controls for that subject.
5. Prices, payment, and authorization holds
Prices, unlock fees, per-minute charges, packages, taxes, and other applicable charges are displayed in the app or communicated before a ride. By starting a ride or purchasing an offering, you accept the displayed price and authorize Bimba and its payment providers to charge your selected payment method.
Bimba or its processor may place a temporary authorization hold to validate the payment method and anticipated charges. A hold is not necessarily a final charge; the issuing bank controls when released funds become available. You must maintain a valid payment method and are responsible for unpaid balances, lawful collection costs, and vehicle-related charges authorized by the Rider Agreement.
6. Promotions, passes, credits, and wallet balances
A promotion, pass, credit, subscription, or wallet balance is subject to the terms shown when offered, including eligibility, duration, location, vehicle, usage, and renewal limits. Unless required by law or expressly stated, promotional value is non-transferable, not redeemable for cash, and expires as disclosed. Paid value will be handled as required by applicable law. Bimba may correct errors or cancel benefits obtained through fraud, duplication, abuse, or violation of offer terms.
7. Cancellations, refunds, and disputed charges
You may stop before unlocking a vehicle without a ride charge, except for a clearly disclosed reservation or cancellation fee. Once a vehicle is unlocked, usage charges accrue until the ride is properly ended and the vehicle is locked and parked as instructed.
If a vehicle cannot be used because of a verified defect, end the ride safely and promptly contact support with the ride details. Bimba may issue an appropriate refund or credit after review. Refunds are not automatic for change of mind, failure to follow parking or ride-ending instructions, loss of connectivity, depleted personal-device battery, or conditions outside Bimba’s reasonable control, except where required by law.
Report an incorrect or unauthorized charge promptly to hello@gobimba.com or +506 6358-1026 and include the account contact, ride date, approximate start and end time, vehicle identifier, and reason for the dispute. We will investigate and provide the remedy required by law. A bank chargeback does not eliminate a valid underlying debt.
8. Acceptable use of the platform
Do not interfere with security or operation; reverse engineer, scrape, copy, or commercially exploit the Services; use bots or automated tools without written permission; introduce malicious code; impersonate another person; access another account; evade fees or controls; submit false reports; misuse support; infringe rights; or use the Services unlawfully. You may not remove notices, copy Bimba databases, or use Bimba content or marks to imply endorsement.
9. Communications and electronic contracting
You agree that account creation, acceptance by app, website, QR code, electronic signature, or unlocking process may form an electronic contract. You must have an opportunity to review applicable terms before acceptance. Save or print them for your records.
We may send transactional, safety, legal, billing, account, and support communications electronically. Marketing communications are subject to applicable consent and opt-out requirements. Keep your email and phone number current; notices sent to your registered contact information are considered delivered to the extent permitted by law.
10. Privacy and location
Our Privacy Policy explains how we collect and process account, payment, device, location, ride, identity, and support information. Precise vehicle and ride location is fundamental to finding, unlocking, operating, parking, securing, and recovering vehicles. By using the Services, you acknowledge the processing described in that Policy.
11. Intellectual property and feedback
The Services, software, designs, maps, text, graphics, logos, trademarks, photographs, videos, and other content are owned by Bimba or its licensors and protected by law. Bimba grants you a limited, revocable, non-exclusive, non-transferable license to use the Services personally in accordance with these Terms. No other rights are granted.
If you voluntarily provide suggestions or feedback, you grant Bimba a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, without identifying you publicly unless permitted.
12. Third-party services
The Services may depend on app stores, payment providers, maps, communications, identity verification, analytics, social networks, or other third parties. Their separate terms may apply. Bimba is not responsible for independent third-party services, outages, content, or acts, except to the extent required by law.
13. Suspension and termination
You may stop using the Services and request account deletion, subject to completing active rides and paying valid balances. Bimba may suspend or terminate access, cancel a ride, or restrict features for safety, legal, payment, fraud, misuse, account-security, or Terms violations. Where appropriate and lawful, we may provide notice and an opportunity to address the issue. Provisions that by nature should survive—including payment, intellectual property, disclaimers, liability, indemnification, disputes, and records—survive termination.
14. Service disclaimers
To the fullest extent permitted by law, the website, app, and platform are provided “AS IS” and “AS AVAILABLE.” Bimba does not guarantee uninterrupted, error-free, secure, or universally available operation, or the accuracy of estimated location, range, route, travel time, or availability. This platform disclaimer does not replace the vehicle-specific provisions of the Rider Agreement and does not limit mandatory consumer guarantees.
15. Limitation of liability
To the fullest extent permitted by Costa Rican law, Bimba and the Protected Parties identified in the Rider Agreement are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from the platform. Any vehicle-use claim remains subject to the Rider Agreement. Nothing here limits liability that cannot lawfully be excluded, including applicable non-waivable consumer rights or liability for gross negligence or willful misconduct where exclusion is prohibited.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Bimba and its affiliates, personnel, contractors, successors, and assigns from third-party claims, losses, liabilities, costs, and reasonable legal fees arising from your unlawful conduct, misuse of the platform, infringement of another’s rights, false information, or breach of these Terms. Vehicle-related indemnification is governed additionally by the Rider Agreement.
17. Governing law and disputes
These Terms are governed by the laws of Costa Rica. You and Bimba will first attempt in good faith to resolve a dispute informally, normally for 30 days after written notice. Any arbitration, individual-action requirement, opt-out right, small-claims exception, or court jurisdiction applicable to vehicle rentals is stated in the Rider Agreement. Mandatory consumer rights and access to competent Costa Rican authorities remain unaffected where they cannot be waived.
18. Changes
Bimba may update these Terms prospectively. Material changes will be communicated by reasonable means, such as an app notice, email, or website notice, and will take effect on the stated date. When law requires renewed express acceptance, we will request it. Continued use after a valid notice constitutes acceptance to the extent permitted by law.
19. General terms
These Terms, the Privacy Policy, Rider Agreement, and any offer-specific terms form the applicable agreement for the Services. If a translation conflicts with English, the English version controls, except where Costa Rican law requires the Spanish consumer terms or another version to prevail. If a provision is invalid or unenforceable, it will be narrowed or severed to the minimum necessary and the remainder remains effective. No waiver is effective unless made in writing by Bimba. You may not assign your account or rights without written consent; Bimba may assign these Terms in connection with a reorganization, financing, or transfer of the business, subject to law.
